Federalist Paper No. 78 and the Courts as a Check on the Executive

The Founding Fathers envisioned the judiciary as a check on both the executive and the legislative branches of government. But in practice, the judiciary has served much more as a check on the legislative branch than on the executive branch. Judge Rakoff will discuss why this is so, and offer speculations as to why this might or might not change in the near future.

About the speaker

Jed S. Rakoff has served since March 1996 as a U.S. District Judge for the Southern District of New York.  He also frequently sits by designation on the 2nd and 9th Circuit Courts of Appeals. Judge Rakoff holds the position of Adjunct Professor at Columbia Law School and Adjunct Lecturer at Berkeley Law School. He has written over 145 published articles, 650 speeches, 1500 judicial opinions, and co-authored 5 books. In 2014, Judge Rakoff was listed by Fortune Magazine as one of the World’s 50 Greatest Leaders.
